The legislative section refers to that section of the government which is responsible for making laws for the country. In India, the president of the country, the Rajya saba, and the Lok saba together form the legislative union which creates or amends laws included under the union list. The Rajya saba is also known as the council of states and the lok saba is the house of people. The members of Rajya saba are elected by the electoral college of the elected state assembly with a system of proportional representation. The members of the Lok saba are elected directly by people of a constituency who are of age eighteen years or above. The union list mentions all the subjects regarding which this legislative union can make decisions.
The legislative lists describe the matters coming under each institution's authority. There are mainly three lists, they are the union list, the state list, and the concurrent list. The union list has about a hundred subjects on which only the union legislature (consisting of the president, the Rajya Sabha, and the Lok sabha) has the power to make laws. On the matters listed on the state list, the state governments have the power to make laws. In the case of the concurrent list, the power is shared by both the union legislature and state legislature. The seventh schedule of the Indian constitution mentions these three lists.
The union list contains subjects of national interest regarding which the central government has the sole authority to make decisions. Currently, the union list contains ninety-seven subjects under it.101st amendment of the Indian constitution act,2016 amended parts of the union list for the introduction of the GST system of tax collection.
Ninety-seven subjects are coming under the union list. Some of the topics coming under the union list include national defense, railways, communication, banking, foreign affairs, etc. For the subjects coming under this list, the whole country must follow the same law hence the laws concerning them are made at the central level.
The subjects of taxes on services and goods of the union list were affected by the amended act in 2016.
Entry 92 and 92 C were removed in the 2016 amendment from the union list in 2016.
